Restless Grind Productions, LLC, DBA Advisor Guide Marketing, (the “Company,” “we,” “us” or “our”) provides this Privacy Policy to inform you (“User,” “you” or “your”) and our other users of our policies and procedures regarding the collection, use and disclosure of information we receive from users of  https://www.advisorguidemarketing.com, and all of its subdomains and related websites, including all public and secured areas and the interactive and passive content, products and services made available there (collectively, the “Site”).  Together, this Privacy Policy and the Terms of Service Agreement constitute a binding legal agreement between you and us regarding your access to and use of the Site (the “Agreement”).  Any capitalized terms used but not defined in this Privacy Policy have the meanings given to them in the Terms of Service Agreement.

1.  Are there any restrictions on who may access and use the Site?

If you are under the age of 13, you may not access or use the Site.  Any user providing personal data is certifying that he/she is over the age of 13.  If a parent or guardian becomes aware that his or her child under the age of 13 has provided us with personally identifiable information without their consent, he or she should contact us at  in**@ad*******************.com  so we can delete such information from our files.

2. Will we ever make changes to the Privacy Policy, and how will you know if we do?

This Privacy Policy may be updated at any time and from time to time for any reason, and each version will apply to information collected while it was in place.  You are advised to consult this Privacy Policy regularly for any changes, which will automatically take effect when the updated version is posted to the Site.  If you use the Site after such an update has been posted, you thereby agree to the change and accept the updated Privacy Policy in its entirety.

3. Why do we collect information from and about you?

First, and most importantly, we do not collect information from you in order to benefit the Company at the expense of your privacy.  The Site is designed to enable subscribing financial services firms and their designated personnel (“Providers”) to securely and efficiently collaborate with interested members of the public in the information exchange necessary for development of individualized financial plans and to help them manage and store their clients’ data, and we collect information only to further that purpose and not on our own behalf.  In short, we collect information from Users only for use by the Users and their respective Providers or to enable us to respond to a User’s request for information or assistance.

Additionally, please note that information, other than A27 Data, collected through the Site is processed by us but not controlled by us.  Providers are able to see all information provided by Users invited by them.  We are an independent contractor that provides cloud-based management software for the use of Providers and the people they serve, and are not (and do not represent) a Provider.  As such, we cannot control how Providers handle information you give to them, either through the Site or otherwise.  You should always exercise caution when sharing your personal information with others and decline to provide information to any person you do not trust.

4. When do we collect information and what types of information do we collect?

The Site does not include any means for Users to register themselves or unilaterally access any secured area of the Site, and the only information capable of collection in the public area of the Site is the information that Users voluntarily send to us through our information or support request forms.

A User who has been invited by a Provider to access the Site’s “Discovery” interface (“Collaboration Portal”) may log in through a randomly-generated, unique URL and provide information requested by the Provider by entering text into a web form and uploading documents (collectively, “User Input”).  Your provision of User Input is always optional, although the scope and extent of the User Input (if any) you provide may impact your Provider’s ability to provide you with services.

Users who are Providers and have access to the secured Provider portal on the Site (the “Subscriber Portal”) may also provide information about themselves (“Profile Information”) and information and documents pertaining to clients and prospective clients (“Supplemental Information”) by entering or uploading such information in the Subscriber Portal.

Depending on how you choose to use the Site and whether you are a Provider, information that we collect from you may include: (a) contact-related information, such as your name, contact information and employee and advisor counts, you provide when you contact us for help or information; (b) Provider-requested User Input, such as personal and family information, business information and valuation, insurance information, retirement information, and banking, retirement and other financial information; (c) Provider Profile Information, such as name and contact information; and (d) Supplemental Information, such as a client’s or prospective client’s name, contact information and other pertinent notes.

In addition, we collect certain information that cannot be used to personally identify any user is automatically collected through the use of the Site by all Users.  Such non-personal data ordinarily includes aggregate, summary, or other usage data, and may include, by way of example, statistics regarding total users, information regarding types of Internet browsers used by users, and widget usage patterns. We also collect non-personal data about each user’s IP address to help diagnose problems with our server and administer the Site.

5. How do we use information we have collected?

The software that runs the Site uses “cookies” to enable the delivery of content in all public and secured areas.  Cookies are small files that a website or service provider send to your browser for storage on your hard drive (if you allow) that enables the site’s or provider’s systems to recognize your browser and capture and remember certain information.  Our cookies are temporary “session cookies” that contain only a string of randomized characters and last only as long as any individual visit to our Site, which automatically times out after 15 minutes of inactivity.  These temporary session cookies are technologically necessary for the proper operation of the Site and do not collect any information about you or persist in existence after you leave the Site.

We do not share personally identifying information collected on the Site, including email addresses, with third parties for their direct marketing or solicitation.  We may use your information to (a) deliver the Site services and features desired by you, (b) improve our services to you, and (c) contact you from time to time to respond to your inquiries or provide you with important information or required notices about the Site.  We also store your information, and may back up or archive copies of your information, in order to provide the Site to you and to comply with applicable laws and regulations.  We reserve the right to transfer your information in the event of a transfer of the ownership or substantially all of the assets of the Company, such as an acquisition by or merger with another company.  If an acquiring company should plan to materially change this Privacy Policy, we will notify you in advance of such change

We also may, from time to time, share information we have collected from and about you with law enforcement, other governmental agents, or other persons as required by law.  We also reserve the right to share your information with third parties as necessary, in our sole discretion, to protect the rights, property or safety of us, our Users, or any child, to preserve the security of our Site, and to prevent or address a threat of harm, violation of law, commission of fraud, of breach of any agreement to which we are a party.

6. Is your information secure?

We are very concerned with the safety and confidentiality of your personally identifiable information. We require password protection and have implemented physical, electronic, and procedural safeguards to protect personal information about you.  We limit access to personal information about you to employees and authorized partners who need to know that information in order to operate, develop or improve the Site.  Please be aware that, although we endeavor to provide reasonable security for information in our possession and control, no security system can prevent against all potential security breaches, and we bear no liability for uses or disclosures of personal data or non-personal data arising in connection with the theft thereof.  Note that you are also responsible for safeguarding the confidentiality of passwords to the Site, and we bear no liability for access to, use or disclosure of personal data if such access, use or disclosure arises in connection with the theft or disclosure (whether intentional or negligent) of such User’s password.

7. Can you stop or limit our collection of information from you?

Yes—but, as explained above, due to the nature and technological requirements of the Site, it cannot function without the use of session cookies, and any decision by you to limit or stop providing User Input requested by a Provider may adversely affect the Provider’s ability to provide you with financial services.

If you do not wish to have cookies placed on your device, you should set your browser to refuse cookies before using the Site, with the drawback that certain features of the Site may not function properly without the aid of cookies.

If you do not wish to have information collected from you by the Site, do not use the Site.  You may cease using the Site at any time.

The Site does not currently support Do Not Track protocols and will not respond to a Do Not Track header.

8. How do I access, maintain or delete my information?

Users with accounts on the Client Portal may access their account profiles at any time to update personal data contained within that account profile.  Subsequent uses or disclosures of information by us will reflect those changes. Certain information is necessary in order for us to provide the Site; therefore, if you delete such necessary information you may not be able to use the Site.

In the event you desire to discontinue your use of the Site and have your information removed from our systems, please send your request to in**@ad*******************.com Note that we may be unable to remove any User Data that is not controlled by us, such as Supplemental Information entered or uploaded by your Provider, or copies of User Data required to be maintained by applicable law or regulation.

SMS Privacy Policy

Advisor Guide Marketing is committed to protecting your privacy. This Privacy Policy (the “Policy”) governs how we treat the Personal Information that we collect and receive from you in connection with your use of the SMS Service (“Service”), which we make available to you through a third-party service provider.

By using the Service, you agree to the terms of this Policy. Advisor Guide Marketing reserves the right, in its sole discretion, to modify or change this Policy at any time with or without prior notice to you. What Personal Information is collected about you:

How Advisor Guide Marketing uses Personal Information about you:

Each message that you send through the Service (either to us or to other users of the Service) is stored on our servers. We retain these messages on our servers. Advisor Guide Marketing utilizes servers and services owned by third parties.

Opting in

A mobile user might opt-in by:

Sending an Mobile Originating (MO) message containing an advertising keyword,

Filling out a paper form that includes their phone number, or

Signing up at a point-of-sale location.

Opting out

Advisor Guide Marketing’s third-party service provider gives you the ability to opt out of the Service for any reason. You can opt out by texting “STOP” or “QUIT”.

We reserve the right to send you certain communications relating to the Service, such as announcements and administrative messages, without offering you the opportunity to opt-out of receiving them.

The Service is not intended for children under 13, and Advisor Guide Marketing does not knowingly collect information from children under the age of 13.

Children aged 13 or older should not submit any Personal Information without the permission of their parents or guardians. By using the Service, you are representing that you are at least 18, or that you are at least 13 years old and have your parents’ permission to use the service.

Use of the Advisor Guide Marketing text message-based services (the “Service”) is subject to the following Terms of Service. These terms constitute a legal agreement (the “Agreement”). Please read them carefully.

Advisor Guide Marketing will allow several different opportunities, such as a entering a phone number online, to opt-in to SMS services.

You can cancel the Service at any time. Just text “STOP”. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time, and we will start sending SMS messages to you again.

We are able to deliver messages to the following mobile phone carriers.
